Introduction

This Terms & Conditions Agreement ("Agreement") governs your use of the website https://medeasy.ai ("Platform"), operated by Bizionic Technologies Private Limited ("the Company"). By accessing or using this Platform, you agree to comply with and be bound by this Agreement, including any policies and guidelines incorporated by reference. If you do not agree, please do not use this Platform.

The Company reserves the right to modify, revise, or update this Agreement at any time. Changes are effective immediately upon posting. It is your responsibility to review this Agreement periodically.


Services

The Platform provides telehealth services connecting users with independent healthcare providers, including doctors and medical professionals ("Healthcare Providers"). The Platform serves solely as a facilitator and is not engaged in the provision of medical services directly.


Patient Consent and Use of Telehealth Services

By using the Platform, you consent to receiving healthcare services via telecommunication technologies. You acknowledge the limitations and risks associated with telehealth, including but not limited to potential incomplete information, privacy limitations, technological failures, and that telehealth consultations may not be appropriate for all medical conditions.


Emergency Use Disclaimer

This Platform is not intended for emergency medical situations. If you are experiencing a medical emergency, call your local emergency service immediately.


Independent Contractor Relationship

Healthcare Providers offering consultations through MedEasy.ai are independent contractors and are not employees, partners, agents, or representatives of the Company. The Company does not provide medical advice, diagnosis, or treatment.

All medical advice, prescriptions, diagnoses, treatments, and any healthcare services are the sole responsibility of the Healthcare Providers. The Company disclaims any liability arising from any interactions between users and Healthcare Providers. In case of discrepancies, negligence, malpractice, incorrect advice, or any healthcare errors, full legal responsibility rests exclusively with the Healthcare Provider involved. The Platform only facilitates connections and is not liable for any healthcare outcomes.

Healthcare Providers are responsible for ensuring that they are properly licensed, credentialed, and authorized to provide healthcare services in the jurisdictions where users are located. Users are solely responsible for verifying the credentials, qualifications, and licenses of any Healthcare Providers before seeking services.


Prescription Services

If prescription services are provided, they are subject to the Healthcare Provider's discretion and applicable law. The Platform does not guarantee that a consultation will result in a prescription.


Geographic and Jurisdictional Limitations

Healthcare Providers are authorized to offer services only within the jurisdictions where they are properly licensed. Users accessing the Platform from outside India must verify compliance with local telehealth regulations.


User Responsibilities

Users agree:

  • To provide accurate, complete, and updated information.

  • To seek independent verification before relying on any advice received.

  • To use the services responsibly and acknowledge the limitations of telehealth consultations.

  • To use the services only if aged 18 years or older, or with legal guardian consent if underage.

  • To acknowledge that telehealth consultations are not a substitute for in-person medical evaluations where clinically necessary.


Content Ownership and Restrictions

All intellectual property rights, trademarks, graphics, layouts, logos, and content created by the Company are owned exclusively by the Company. Unauthorized use, reproduction, or distribution is prohibited.


Third-Party Links

The Platform may contain links to third-party websites. These are provided for your convenience. The Company does not endorse or assume responsibility for content, services, or privacy practices on such third-party sites.


Disclaimer of Warranties

The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Company expressly disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

No information obtained from the Platform creates any warranty not expressly stated.


Payments and Subscription Terms

  • Fees for Services are outlined during subscription and are non-cancellable and non-refundable.

  • Taxes, government charges, or processing fees, if any, are borne by the user.

  • Subscription terms auto-renew unless explicitly canceled.

  • In case of overdue payments, penalties may be levied.

  • The Company reserves the right to terminate services for non-payment.


Limitation of Liability

The Company's liability is strictly limited to the amount paid by the user for the services. The Company shall not be liable for indirect, incidental, consequential, or special damages arising from the use or inability to use the Platform or Services.


Health Information Privacy

The Company endeavors to protect user health information and shall comply with applicable Indian data protection laws, including but not limited to the Digital Personal Data Protection Act, 2023, the European Union General Data Protection Regulation (GDPR), and the Health Insurance Portability and Accountability Act (HIPAA) where applicable.

The Platform does not store or maintain user medical records unless explicitly required by applicable law or necessary for providing services.


Indemnification

You agree to indemnify, defend, and hold harmless Bizionic Technologies Private Limited and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including attorney's fees) arising from your:

  • Breach of this Agreement,

  • Use of the Platform,

  • Violation of third-party rights,

  • Interaction with Healthcare Providers.


Privacy

The Company is committed to protecting user privacy. Please refer to the Privacy Policy available on the Platform for information on how user data is collected, used, and protected.


Governing Law and Jurisdiction

This Agreement shall be governed by and construed under the laws of India, without regard to its conflict of law principles. Users accessing the Platform from outside India expressly agree that any disputes, claims, or actions arising out of or related to this Agreement or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in the City of Hyderabad, State of Telangana, India.


Dispute Resolution

Users waive any right to bring claims in a class-action format. Claims must be pursued individually.


Force Majeure

The Company shall not be responsible for failure or delay in performance due to events beyond its reasonable control, including natural disasters, war, acts of terrorism, labor disputes, or governmental actions.


Termination

The Company may suspend or terminate user access to the Platform at its sole discretion, without prior notice, for any violation of this Agreement.


International Use

Users accessing the Platform from outside India do so at their own initiative and risk and are responsible for compliance with local laws. MedEasy.ai makes no representations that the Platform or Services are appropriate or available for use in any jurisdictions outside India.


Assignment

Users may not assign rights or obligations under this Agreement without prior written consent. The Company may assign its rights without restriction.


Agreement to be Bound

By using the Platform, you agree to be legally bound by this Agreement and the incorporated policies.
